Terms of Service
These Terms of Service ("Terms") constitute a legally binding agreement between Anchor Demand Inc ("Company," "we," "us," or "our") and the merchant or business entity ("Merchant" or "you") installing or using the GetJacked application (the "App") on the Shopify platform. By installing, accessing, or using the App, you agree to be bound by these Terms.
1. Description of the App
GetJacked is a loyalty and rewards application for Shopify merchants. The App enables merchants to create and manage points-based loyalty programs, customer reward tiers, and a shopper-facing Rewards Center embedded in their Shopify storefront.
2. Eligibility and Account Registration
To use the App, you must have an active Shopify store, be authorized to enter into binding agreements on behalf of your business, and comply with these Terms and Shopify's terms. You are responsible for maintaining the security of your Shopify account credentials and for all activity that occurs under your account.
3. License
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App solely for your internal business purposes in connection with your Shopify store. Restrictions apply as described in the full Terms.
4. Shopify Platform
The App operates on and integrates with the Shopify platform. Your use of the App is also subject to Shopify's Terms of Service and related policies. We are not responsible for changes to Shopify that may affect App functionality.
5. Fees and Billing
Any fees are disclosed in the App listing and billed through Shopify's Billing API. We may change pricing with notice; continued use constitutes acceptance.
6. Merchant Responsibilities
Merchants are responsible for lawful use of the App, accurate configuration of loyalty terms, communicating program terms to customers, honoring rewards, and maintaining an up-to-date privacy policy reflecting data collection.
7. Data and Privacy
Use of the App is governed by our Privacy Policy available at https://getjacked.io/privacy, which is incorporated by reference. You must obtain necessary consents from your customers to collect and process their data.
8. Intellectual Property
All intellectual property rights in the App remain the property of Anchor Demand Inc. You retain ownership of your store and customer data.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR LIABILITY IS LIMITED. SEE THE FULL TERMS FOR DETAILS.
